How much do you charge?
You will never have to pay me for the work I do for you. Every consultation is free, even if you do not hire me to represent you. I get paid only if I am able to get you a settlement with the insurance company. If there is no offer or recovery from the insurance company, no matter how much time I spend working on your case, you will never have to personally pay me anything. For most car and truck wreck cases my fee is thirty-five percent of the amount of any settlement. For more complex cases like premises liability or cases that have to be litigated (i.e. lawsuit filed, trial, etc.) my fee is forty percent of the amount of any settlement.
Who pays for the costs of litigation?
My firm will pay all the costs necessary to pursue your case. An example of the costs involved is the cost of obtaining certified medical records, hiring experts, filing fees, postage, etc. We keep all costs itemized in a QuickBooks account. If and when there is a settlement with the insurance company, my firm will get reimbursed these costs from the settlement proceeds after attorney fees are paid. If there is no offer or recovery from the insurance company, no matter how much money I spend pursuing your case, you will never have to personally pay me anything.
How do I know which attorney to choose?
There are a lot of good personal injury attorneys in Atlanta. Most injury attorneys really do care about their clients and we work very hard to get the best recovery for each and every client. Unfortunately, there are a lot of inexperienced attorneys. My advice comes down to this: go with an attorney who has a lot of experience handling these type of cases and go with the one you feel most comfortable.
What am I entitled to receive as compensation if I am injured?
The at-fault person who caused your injury is required to reimburse you for the medical bills you incur, the income you lost as a result of you being out of work, and a fair amount to compensate you for the pain, aggravation and inconvenience you experienced. The at-fault person’s insurance company will pay whatever is owed. This is why we have insurance!
What should I do when I’m involved in a car wreck?
- Call 911 and report the wreck. Do not agree to exchange insurance information and work it out with the other driver.
- If you are injured, tell the investigating officer where you are hurting and get medical attention immediately.
- Get the names and contact information from every potential witnesses. The police officer will not write down the names of every person who stops at the scene.
- Take photographs of both vehicles.
- Call your insurance company immediately and report the wreck.
- Call your lawyer. Insurance companies have professional negotiators. So should you!
Do I have a claim for medical malpractice?
Every healthcare professional (doctor, nurse, etc.) owes you a duty to provide the same level of care and skill that an ordinarily prudent healthcare professional would provide a patient in the same situation and like surrounding circumstances. If your healthcare professional fails to provide you with this same level of care, your healthcare provider is deemed to be “negligent”. If you are harmed or injured as a result of your healthcare provider’s negligence, then you have a claim for what is called “medical malpractice”.
What should I do if I am injured while at a store or business?
- Request the manager to get involved and prepare an incident report.
- Get the names and contact information of any person who saw you fall.
- Take photographs of the area where you fell and what caused you to fall.
- If you are injured, get medical attention immediately.
- Ask the manager to preserve any surveillance video that may have recorded your fall.
- Call your lawyer. Insurance companies have professional negotiators. So should you!
